Court Strikes Down Obamacare Transgender Mandate

(The Daily Signal) While family and friends were counting down to the new year, I was watching a different kind of countdown—whether doctors and health care providers would be forced to violate their medical judgment and provide procedures, including gender transition services and abortions, under a new government mandate.

The mandate is a 362-page regulation that claims to interpret part of the Affordable Care Act. It was issued in May 2016, and major portions of this mandate would have kicked in on Jan. 1.

Becket Law had asked a Texas court for an order protecting health care providers. It was less than nine hours to midnight when we heard the good news: A Texas court issued an injunction protecting doctors and the families they serve from the mandate.

The court ruling came after eight states, an association of almost 18,000 doctors, and a Catholic hospital system challenged a new federal regulation that requires doctors to perform gender transition procedures on children, even if the doctor believes the treatment could harm the child.

Doctors who followed the Hippocratic oath—the historic medical vow that doctors take to act in the best interest of their patients—would have faced severe consequences, including losing their jobs.

This is a commonsense ruling. The government has no business forcing private doctors to perform procedures on children that the government itself recognizes can be harmful and exempts its own doctors from performing. The ruling ensures that doctors’ best medical judgment will not be replaced with political agendas and bureaucratic interference.

The federal regulation applied to over 900,000 doctors—nearly every doctor in the U.S.—and would have cost health care providers and taxpayers nearly $1 billion.

The government itself does not require its own military doctors to perform these procedures. It also does not require coverage of gender transition procedures in Medicare or Medicaid—even for adults—because the government medical experts that oversee those programs did not believe medical research demonstrates that gender reassignment surgery improves health outcomes, with some studies demonstrating that these procedures were in fact harmful.

But under the Department of Health and Human Services rule developed by political appointees, doctors citing the same evidence and using their best medical judgment in an individual case would have faced potential lawsuits or job loss.

A website about this court case provides leading research on the issue, including guidance the government itself relies on. This research shows that up to 94 percent of children with gender dysphoria will grow out of their dysphoria naturally and live healthy lives without the need for surgery or lifelong hormone regimens.

The government desperately wanted to avoid a court ruling on these facts, telling the Texas court that no injunction was needed. Instead, doctors should wait around to see if they got sued and then see whether the government would agree, based on the circumstances, that they were entitled to protection.

That argument was pretty rich coming from the Department of Health and Human Services, which has spent the last five years fighting lawsuits to limit conscience protections for groups like the Green family, who own Hobby Lobby, and the Little Sisters of the Poor.

In those cases and others, the government has been quick to argue for strict limits on protections like the Religious Freedom Restoration Act and the Church Amendment, which protects providers from having to perform abortions.

Never did the government claim that rulings on the contraceptive mandate should wait until someone brought a lawsuit and the government had time to weigh the issues and pick a side. The court didn’t buy that excuse, instead recognizing that the mandate would create immediate and irreparable harm to doctors nationwide.

This ruling is an across-the-board victory that will ensure that the deeply personal medical decision of a gender transition procedure remains between families and their doctors.

This case was brought jointly by Becket Law—which defended Franciscan Alliance, a religious hospital network sponsored by the Sisters of St. Francis of Perpetual Adoration, and the Christian Medical & Dental Associations—and by the Texas attorney general and the states of Texas, Wisconsin, Nebraska, Kentucky, Kansas, Louisiana, Arizona, and Mississippi.

        Yes, but what JFK did do is allow public sector unions to collectively bargain which every president before him knew would be asking one part of the population to bend over while the other part – government employees – received better and better salaries and bennies paid for by those doing the bending. Now of course, there are underfunded pensions all across the country just like social security which was meant to be for widows and orphans not a retirement fund. I mean when you factor in that the average life expectancy at the time for men was 63 and you started pymt at 65 it’s not rocket science. Anyway, sorry for getting off subject which is extremely important! I hope something can be passed that puts this crap to rest once and for all so religious beliefs and doctor/patient/parent medical decisions are not and will not be made by some tool in Washington.

But those companies are generally too gutless to put up that sign. They’d rather make an issue of it after the fact.

        What you should genuinely be concerned about is this: No one cares if you are a transsexual….really — no one gives a damn — until it gets shoved in their faces by a tyrannical government. So you have nothing to thank Obama and the democrats for, except they turned a very bright spotlight on your toilet habits. Think about that.

I look like any other guy except whats in my pants because 1) I cant afford the surgery and 2) the medical community has not perfected “holes” to poles yet. I had some of the resources to make me look that the way I do. But does it suck “Yes” specially when there is no where for me to pee. And dude, you know when you got to go you got to go. I am an 56 year old served in USAF for 11 years and I have work all over the world. None of my co workers knew about me. But the bathroom issue is always are worst issue.Several trans people mainly male to female trans women have it so much harder then female to male trans people. So many of them have lost their jobs and no one will hire them, “because they look weird” they do their best to “pass” until they can get insurance and or afford the proper surgeries and or procedures. I know very personally over 300 trans people and it is so hard for them, I deal with the real numbers not the right wing opinion numbers. These trans-women are for the most part harmless, its not going to hurt teaching your kids people can look different. Trans women go in the stalls, wash their hands and go out. I suggest to whoever don’t let little ones go alone in any restroom.But, statistically it is not the trans people you need to worry about but, your family members, neighbors and co workers that end up being the problems and least that is my personal experience, the high 1 out of 4 stats and several hundred people I have counseled from being molested by the family, friend and or co workers.
          You should someday take the time to get to know a trans person or find out the amazing history , which includes medal of honor recipients(civil war), noted writers, doctors,lawyers, researchers and the list goes on. People will learn someday of their tremendous contributions to society instead of thinking of them as just weirdo’s and child molesters.

          The drug DES my mother took was testosterone basically for helping for both my brother and I not to Be miscarriaged. I was born 1961 and my brother 1967 there are 1000’s of Rainbow people their mothers took this drug and it can be proven that this drug and several other things can effect this tiny little egg with changed hormone washings and different times-
          I have 1000’s of hours of research and I have to live this life- you really don’t get it when the Lord said some are born this way-Its time to take your religious hat off and pay attention to what God is doing on the earth-

    These are elective procedures, something the recipient wants, not something necessary for sustaining life or recovery from disease or injury. If the operations they want are legal (and almost certainly even if they’re not) there will be someone who will provide them. A free market works that way. It’s not GP medicine anyway – see a specialist. There’s no sound argument for government – meaning taxpayers – subsidizing elective procedures.

        Definitely thank you : ) I’m one of those whose very good ppo with very low copay was changed to 30/60 copay, 5000$ deductible all for a grand increase of 4x what I was paying all to end up with worse coverage as of I had no insurance at all : ) I now have to pay out of pocket for all of my sons continued long term vision therapy and have to pay a 60 $ copay every time he sees his doctor for the quarterly evaluations while those on the state get theirs for free. It’s all very expensive so why should have to pay through the nose oh wait it’s so others can pay NOTHING! at my son’s expense grrrr. So yes don’t press 1 : )

    As a retired surgical RN, I know that there are surgeons and nurses across the country breathing a sign of relief. Murder is murder and that is what abortion is. We are the people who who actually know first hand that it is babies being murdered, not blobs of tissue. I’ve written about this before and been published one in a newspaper on this subject a decade or more ago, but focused just on the life aspect. Catholic hospitals are packed with surgical nurses that work there simply because they won’t have the constant pressure by other hospitals to do abortions.
    When I did some surgical agency work, I asked to be protected in my contract which I then was, but hospitals still tried to trick me into doing abortions by claiming that a woman had already lost her child naturally and just needed to have any remaining placental tissue removed. Once a nurse accepts a patient and interviews them, they are stuck because they could lose their license for patient abandonment if they then refuse. I had already been alerted to this deception so I always read the patient’s chart when I saw my name on the board with a D&C next to it. This wasn’t a one time thing; it was routine to try and trick any pro life agency RN.
    There is a reason that surgical agency nurses are tricked. It is because the majority of nurses on staff at secular hospitals are also pro life. The hospitals would rather trick an agency nurse than force a staff nurse to do abortions. I was even protected in my contract from setting up a room for an abortion. Hospitals put pressure on pro life agency nurses to set up a room for an abortion and then would argue with the nurse that since she had already set up for the abortion, she had accepted the case and were already guilty of being a part of the abortion. I already looked at it that way.
    Nurses did not become nurses to murder babies or hurt people. They are caring people who value human life and protect it. That is why abortion clinics came into being in the first place. What these immoral pro baby killers fail to see is that the majority of surgical nurses who are at the Catholic hospitals to avoid them completely, will stop practicing in the surgical field. Thousands of seasoned highly skilled surgical RNs would be gone across the country. There would also be plenty of surgical nurses lost at the secular hospitals too. We have integrity. It is a part of who we are and God help the patients who would end up with inexperienced surgical nurses, many brought in from foreign countries with lower standards. Who will even be there to train them?
    This is one of many reasons that we must get our states to take their power back and eliminate much of the bloated federal government. The federal government has some good people working for them, but far more inept people because they hire employees based on gender identity and race instead of experience and knowledge just like many colleges hand out their degrees and scholarships. They always look at the present political situation and never look at the effect their stupidity will have on the nation and it’s citizens. They don’t even care until it bites them in the a-s. Nurses also realize that gender identity is a psychological issue, not a surgical one.
    The government encourages abortions without parental consent. When will they have children brought in for sexual mutilation regardless of their parents wishes? Kids are easily manipulated by both other children and adults.
