(Fred Lucas, The Daily Signal) President Donald Trump won a big victory Monday in the Supreme Court, which upheld his “extreme vetting” on immigration into the United States.

The dispute over the policy stemmed from its application to six majority-Muslim countries. Lower federal courts in California, Hawaii, and Maryland ruled the ban was unconstitutional.

In September, the administration revised the policy to add North Korea, Venezuela, and Chad to the list. It dropped Sudan and kept Iran, Libya, Somalia, Syria, and Yemen.

The high court’s order allowing the Trump administration to enforce the policy in full was unsigned, but Justices Ruth Bader Ginsburg and Sonia Sotomayor opposed the decision and favored leaving the lower court rulings in place, the Associated Press reported.

“By a 7-2 vote, the Supreme Court has decided—at least temporarily, pending a final determination of the merits—that decisions affecting our national security should be made by Congress and the president, not by a single federal judge sitting in a courthouse in Hawaii,” said John Malcolm, head of the Institute for Constitutional Government at The Heritage Foundation. “Presidents are given primary responsibility for protecting our homeland. Federal judges are not.”

“Moreover, the president receives daily classified intelligence briefings about the many threats we face, and congressional leaders also receive such briefings regularly,” Malcolm continued in a public statement. “Federal judges do not. By entering its order, the Supreme Court has sent a message that the important constitutional issues involved in this case will be resolved in an orderly fashion and in due course, and that our nation’s security will not be needlessly imperiled by one overreaching lower federal court judge.”

White House spokesman Hogan Gidley told reporters on Air Force One Monday the ruling didn’t come as a surprise.

“We are not surprised by today’s Supreme Court decision permitting immediate enforcement of the president’s proclamation limiting travel from countries presenting heightened risks of terrorism,” Gidley said. “The proclamation is lawful and essential to protecting our homeland. We look forward to presenting a fuller defense of the proclamation as the pending cases work their way through the courts.”

The court order said the policy can take full effect while other legal challenges work their way through the courts. Lower court judges ruled people from the six majority-Muslim nations with relatives in the United States had a “bona fide” claim to enter the country.

The Supreme Court gave partial support to the administration’s travel ban in June, when it found that travelers from the six predominantly Muslim countries could be banned if they lacked direct connections to the United States.

      They are way left for sure, but I think Ginsburg was appointed by Clinton a long time ago; she is well into her 80’s.

        You are correct about Ginsburg’s appointment. An oversight on my part and thanks for the correction. I don’t see any real difference between either of the Clintons’ or Obama’s agenda. We can only hope and pray, she retires soon so Trump can appoint a constitutional conservative that loves this country and it’s laws.

          Hopefully he gets to appoint 3 more. Kennedy’s replacement will be a lateral move, but the other 2 would swap out left for right. Would love a 7 to 2 advantage, and replace all with 40 year old’s so the court holds for generations to come.

            I agree completely. However, I have concerns about relying to heavily on the supreme court regarding policy. The supreme court is only one third of the three branches of federal government and all three are co-equal or supposed to be anyway. I’m sure you already know the supreme court is supposed to ONLY interpret laws in light of our constitution. With that in mind, again I agree a 7-2 conservative majority of strict constitutionalist judges would be a God-send to keep the other two branches in check.

            The checks and balance system as set up in the constitution is the greatest feature of our government. The judges appointed by Conservatives have, for the most part, done a great job as to fairness. A great example was Scalia; burning of the flag greatly bothered him, but he held it as 1st Amendment protected. In lower courts judges appointed by Liberals, especially Obama, have become political arms like the guy in Hawaii. Most Supreme Court Justices have not gone that way except for Ginsburg and lately Sotomayor, Obama probably thought that Elena Kagan would toe the mark like Sotomayor has, but she did not when it came to the travel ban. Her interpretation, as well as those of the other 6 Justices, of it being a function of the Executive Branch was spot on and I am sure Obama crapped his drawers and would rescind her appointment if he could. He is supposed to be a constitutional scholar but he is strictly a selected leftist expert. They would love to rewrite the Constitution, but in lieu of that they look at it selectively. They love the 5th Amendment, hate the 2nd and love the 1st if the press is bad-mouthing President Trump or BLM is shouting to fry cops, but don’t like it if I say Bill Clinton is a dirt bag, or Al Sharpton is a racist.

I will add that the constitution can be changed if a constitutional convention is held and the way that is done is if 2/3 of the states call for one. I don’t remember but several are already on record for calling for it .I’m sure you already know this. I hope it doesn’t happen. It is as perfect as it can be in this day and age the way it already is. I believe it and our founders were divinely inspired.

    Question. There are three equal powers in our government. The president: the supreme court and the congress. That being so, then how can a federal court stop an order from the president when the federal court is lower than the supreme court? By doing so, the lower court judge is making himself equal or greater than the president.
